Injustice anyone?

I had a client in custody yesterday. He had failed to appear 2 days ago. 26 years old. Living on the street. No criminal record whatsoever. Not even an arrest.

He was charged with theft...for eating a piece of cheese in a store and not paying.

He was hungry because he is homeless. He opened some shitty package of cheese worth $2 and ate one piece. And the offer from the prosecution, had he accepted, would have put him on probation for three years and 10 days in county jail, which would have set him up so that the next theft could have been charged as a felony and sent him to state prison.

Is there any compassion left in this world??

Sometimes my job breaks my heart.

Tell the judge "de minimus non curat lex" and make a motion to dismiss in the interest of justice. I would attach a check from the account of a friend to the store for two dollars. (you can't put it up it violates ethics rules) for "restitution".

I had a case like this. The court made me put up the .85 and then "fined" every lawyer in the court 5 dollars and sent the deft. home with 50 bucks.
